The Company reserves the right to update and change these Terms of Service from time to time without notice. We do not guarantee that the Service will have a 100% uptime or any other percentage (we do not guarantee a SLA - Service Level Agreement). When you download an application setup installation file from our website, you will need to accept a specific License Agreement (also known as End User License Agreement) before installing the selected application. If you install the application via automated ways you automatically agree to the application License Agreement. If you enable automatic product updates you automatically agree to any new and/or modified License Agreement present in the new updated application.

*Here is what you cannot do with the Service:

[1] You cannot share the license keys associated with your account with persons that are not part of your company or that are not your colleagues. 
[2] You can not share the license keys associated with other accounts with others or third-parties. 
[3] You can not make the license keys public (such as posting the license keys to forums, blogs, social networks, comments, etc.).
[4] You must not use the Service for any illegal or unauthorized purpose. 
[5] You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
[6] You can not use the Service for unethical purposes or for any purpose that could be prejudicial to the Company, or to other companies or businesses. 
[7] You cannot use the Service to compare other software and/or services.
[8] You abstain from any activity that could damage, overload, harm or impede the normal functioning of the Service. 
[9] You cannot host/store in your (or third-party) servers and/or websites any files present in this website.

*Additionally, you cannot use the Service for:

[1] You can not use the data, reports or any other information provided by the Service to compare other software or services.
[2] You can not use the Service for deceptive means to discredit or as bait to prove some concept regarding other services and\or software.

- Cancellation and termination of the account

The Company, in its sole discretion, has the right to suspend or terminate your account (including your licenses and/or credits/queries purchased) and refuse any and all current or future use of the Service, or any other Company service, for any reason at any time. Such termination of the Service will result in the deactivation and/or deletion of your Account and/or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. The Company reserves the right to refuse service to anyone for any reason at any time. Violation of any of the agreements present in this Terms will result in the termination of your Account.

The Company may remove content and accounts containing content that the Company determines in its sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Company customer, employee, member, or officer will result in immediate account termination.

- Disclosure of your registration data and information

Notwithstanding any other provision of these Terms, the Company reserves the right, but has no obligation, to disclose any information that you submit or that the Company discovers in performing the Service, if in its sole opinion, the Company suspects or has reason to suspect, that you are abusing the Service or that you have/are used/using fake, inaccurate, inappropriate or untrue information about You, or that you are involved in unethical activities, or that you are involved in any way in activities that violate any local, state, national or international law or regulation. Information may be disclosed to authorities that the Company, in its sole discretion, deems appropriate to handle such disclosure. Appropriate authorities may include, without limitation, law enforcement agencies, child protection agencies or court officials. You hereby acknowledge and agree that the Company is permitted to make such disclosure.

- Here is how and who handle your payments

All the payments are handled by "https://fastspring.com/" Bright Market, LLC d/b/a FastSpring solutions. All FastSpring solutions are secured by FastSpring's enterprise e-commerce infrastructure, which includes a proven payment gateway, advanced fraud prevention, 24x7 customer service and much more. You will not need to enter any information about your credit card or any other sensitive data in the Service or in our Websites to purchase a package, all the payment process is securely handled by our partner FastSpring. In the event that after you have purchased a plan, you have not received the software license key(s) and/or the credits you have purchased, you must immediately contact the Company by email to solve the issue, include the Order ID in the email message. You acknowledge that we can view/edit/delete the details of the orders, which include your name, surname, address, telephone, etc.

- Here is how we handle software licensing

We may use a third-party service named Cryptlex "https://docs.cryptlex.com/" to manage Products software licensing. This means that our site and/or our products may communicate with Cryptlex service to check/validate/activate/deactivate/etc your licenses and these checks may also be performed in a periodic way (such as every 1 day or everytime the application is started). To perform all these checks, your email address (used during the order), your IP address and your PC name (e.g DESKTOP-U81AUA9) associated to your license may be sent and processed by Cryptlex service, this is done to prevent abuses and to create statistics about licenses usage, but also to show in your Customer Portal these information, so you can better manage and understand in which PC the license was installed. - Here is how we handle refunds for services and products

We may provide you the possibility to test our product with a 15 or 30-days free trial and/or by providing you a specific number of free credits/queries and/or by providing you a specific number of days for the free trial period. This way you can fully test our products and then you can decide to purchase a license or a paid plan only if our products meet your requirements.

We do not provide a refund for purchased, unused or already utilized software licenses and/or credits/queries, and/or in case the Service has issues (of any kind) or it is shutdown. We do not offer a SLA (Service Level Agreement) and we do not guarantee the continuity of the Service, however we will do our best to keep the Service active, solve issues (if any) and improve its functionality.

In the event the Service will be shutdown or discontinued, you may be notified via email at least 3 months (90 days) before its shutdown event (but we have no obligation in doing this). Once the product has been shutdown, the credits and/or the software licenses (or any other purchased item) may be lost.

- Here is how we handle the newsletters

When you register to our newsletter, or when you make a purchase via our payment provider, your email address may be sent in our SendinBlue account so we can add your email in one or more lists and send you the newsletters, important product updates, and information about our other awesome projects. Such notice may be provided at any time by posting the changes to the Company site, or the Service itself or may be sent by email to the active and enabled registered users. The Company shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

- Intellectual property, copyrights and rights

Except with respect to the content, including Your content, you agree that the Company and its suppliers own all the rights, title and interest in the Sites, the Service, the Products, and the Company materials. You agree not to modify, adapt, hack, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms used in the Service, the Sites or the Products. Failure to do so may result in penal actions. This End-User License Agreement (EULA) (also referred as "Terms", "License Agreement", and possibly other words) is a legal and forever binding agreement between you (either an individual or a single entity) and the authors of this software product (NoVirusThanks Company Srl). By installing, copying, or otherwise using the software product, you agree to be bound by the terms of this EULA. LICENSE TERMS:
This software is licensed (not sold).
This is a shareware software application, which means it can be used for free for 30-days trial period and after you need to purchase a license to continue using it.
You can install and use the software for 30-days with the purpose to test the software functionalities and to check if it meets your requirements.
You need an active paid subscription license to use this software application after the 30-days trial period has ended.
Subject to Your compliance with the Terms, the Company grants You a limited, non-exclusive, non-transferable, non-sublicensable license to use the software during and for the terms for which you have purchased the software. 
Based on the purchased license type, you can install and use the software at your company (business and enterprise version) or at home (personal version).
Based on the quantity purchased you can install and use the software in a specific number of machines.
A virtual machine (VM) is considered 1 (one) machine.

GENERAL RESTRICTIONS:
You agree not to modify, adapt, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms used in this software product including but not limited to the executable program itself and it's dependencies (libraries).
You cannot integrate/include this software and/or its files in commercial applications and/or commercial services that you redistribute or sell/resell.
You cannot edit/modify/alter the files of this software, including DLL files, executable files, etc. 
*** You can however edit CustomBlock.db, Exclusions.db and IgnoredNotifications.db files.
You cannot create portable/custom versions of this software (or of our other products) and publish the archive on Internet or elsewhere.
We strictly prohibits 3rd parties or websites from offering our products as bundled installers or bundled downloaders.
You cannot sell, resell and/or transfer for a value this software and/or its files and/or its license key.
You cannot host and/or distribute this software or its files in your servers and/or websites and/or media/CD-ROMs.
*** You can however host CustomBlock.db, Exclusions.db and IgnoredNotifications.db files in your servers or websites if you use them with the product Enterprise version.
Failure to respect these restrictions may result in penal actions based upon our best judgement.

DISCLAIMER OF WARRANTY:
THE SOFTWARE PRODUCT IS PROVIDED "AS-IS" WITHOUT ANY KIND OF EXPRESSED WARRANTY. PRIVACY POLICY:
The product has an option to auto-update itself: if you enable the option to automatically download and install product updates, you will automatically agree the new (and potentially modified) EULA of the new product version. When performing the update, the product needs to make HTTP requests to our remote web servers in order to know if there is a new version available and in case to download the new product version. You acknowledge that when a request is made to the remote web server, your IP address may be temporarily stored in the web server logs to prevent and respond to abuse.
The product may auto-install NVT License Manager: this is a separate Windows service application developed by us that is used only to activate and periodically validate the license of the product. The product uses Cryptlex service for software licensing and validation: you can find Cryptlex privacy policy and terms of use here https://docs.cryptlex.com/legal - You acknowledge and agree that when you activate, deactivate, renew, and/or modify the license, or to periodically check if your license key is valid, NVT License Manager app will make HTTP requests to Cryptlex website (for their privacy policy read here https://docs.cryptlex.com/legal). You acknowledge that your IP address, Computer name, and other information are saved in Cryptlex service and are associated with your activated/deactivated license key(s). These information are required to respond to abuse and to generate statistics.
The product will communicate with NVT License Manager: the Windows service application NVT License Manager needs to be installed in your system in order to use, activate and update the product. The product may provide options (that can be enabled/disabled) for cloud Windows process reputation: in this case you acknowledge and agree that this product may make HTTP requests to our remote web servers to know the reputation of a process or of a process behavior. The data sent to our servers is just string-data and not the file itself. Sent data can include the process file name (e.g abc.exe), the process location, the process hash, the process command-line, and other process behavior-related string-type data.
When you purchase a license of this software you acknowledge and agree that payments and invoices are handled by our partner Bright Market, LLC dba FastSpring (privacy policy is here https://fastspring.com/privacy/). You acknowledge and agree that via our FastSpring Dashboard we can manage/view/edit details of the order and/or of the subscription (including your name, address, purchased items, IP address, etc).
You acknowledge and agree that we can send to your email address product updates and announcements, cybersecurity tips, and other information that we believe are worthwhile (don't worry, we hate spam).
You acknowledge and agree that our web servers may be located in different geographic areas (such as USA and Europe) and that we may use different hosting providers, including: Google Cloud Platform, Amazon Web Services, DigitalOcean, Scaleway, Hetzner, OVH.
All connections between the software and the remote web servers are done via a SSL (HTTPS) secure encrypted connection.

You acknowledge, understand and accept that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You are responsible for what you write and what you send. You acknowledge and agree that we may use third-party services such as Zendesk, Inc. - privacy here https://www.zendesk.com/legal/ - to handle support tickets.

APPLICABLE LAW. EXCLUSIVE JURISDICTION:
This EULA is governed by the laws of Italy. Any dispute arising from this agreement and/or its interpretation shall be exclusive competence of the Tribunal of Perugia, Italy, except in case of matters reserved to the jurisdiction of the Specialized Sections in Intellectual Property: in this case the only competent court will be Florence, Italy.
